There is no grey area when it comes to No Smoking zones in Australia. If it is a no smoking zone it is a no vaping zone.
Under the Smoke-free Environment Act 2000 and the Smoke-free Environment Regulation 2016, smoking and vaping are banned in all enclosed public areas and certain outdoor public areas.
The bans protect people from harmful second-hand tobacco smoke.
There is no safe level of exposure to second-hand smoke.
Outdoor public areas include:
- Within 10 metres of children’s play equipment in outdoor public spaces;
- Public swimming pools;
- Spectator areas at sports grounds or other recreational areas used for organised sporting events;
- Public transport stops and platforms, including taxi ranks;
- Within 4 metres of a pedestrian access point to a public building; and
- Commercial outdoor dining areas.
The Australian Government has started to introduce new reforms for e-cigarettes, including changing restrictions around the import, availability, advertising and sale of e-cigarette products and liquids (nicotine and non-nicotine).
More changes will be introduced throughout the year, including stopping the import and sale of non-prescription vapes.
